Skimmy Terms of Use (User Agreement)

These terms govern your access to and use of the Skimmy app and related services.

1) Eligibility (17+)

The Service is intended for users aged 17 and older. By using the Service, you represent that you are at least 17 years old and have the legal capacity to enter into these Terms.

2) The Service

Skimmy is an outfit tracker and wardrobe management tool designed to help you record outfits, organize clothing by season/style/material thickness, identify redundancy, discover usage patterns, and maximize your closet.

We may add, remove, or modify features at any time.

Your Content may include photos, notes, outfit logs, wardrobe items, and related information you submit, upload, store, or generate through the Service.

4.1 Ownership

You retain ownership of your content.

4.2 License to operate the Service

You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and display your content solely to operate, provide, maintain, and secure the Service, provide support, and perform features you choose to use (including optional automated processing of images/text, if available).

This license ends when your content is deleted from the Service, except that backups may persist for a limited time and we may retain information as required by law.

Our collection and use of information is described in our Privacy Policy. Your use of the Service is subject to that policy.

6) Intellectual Property

The Service (including software, design, text, graphics, and logos) is owned by or licensed to us and protected by applicable laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, or create derivative works from the Service.

7) Third-Party Services

The Service may integrate with or link to third-party services. We do not control third-party services and are not responsible for their content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

8) Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9) Limitation of Liability

To the maximum extent permitted by law, Skimmy Team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising from or related to your use of (or inability to use) the Service.

To the maximum extent permitted by law, our total liability for all claims relating to the Service will not exceed the amount you paid to use the Service in the 12 months before the event giving rise to the claim (or USD $10 if you have not paid any amounts), whichever is greater.

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability will be limited to the maximum extent permitted by law.

10) Indemnification

You agree to indemnify and hold harmless Skimmy Team from and against claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your content, or your violation of these Terms or applicable law.

11) Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, posed a security risk, or created legal exposure. You may stop using the Service at any time.

Sections that by their nature should survive termination will survive (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution).

12) Changes to these Terms

We may update these Terms from time to time. We will update the Effective Date and, where appropriate, provide additional notice within the Service. Continued use after changes become effective means you accept the updated Terms.

13) Governing law & dispute resolution (binding arbitration)

These Terms are governed by the laws of our principal place of business, without regard to conflict-of-law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis (not as a class action), except where applicable law prohibits such a waiver.

Either party may seek injunctive or equitable relief for unauthorized use of intellectual property or to prevent irreparable harm, where permitted by law.
